The Basics

Let’s start with a quick overview of key concepts:

MLS: The Multiple Listing Service is a collaborative database where real estate agents share property listings. It’s the backbone of real estate transactions, offering information like price, location, and buyer agent commission (BAC).

BAC (Buyer Agent Commission): This refers to the commission a buyer’s agent receives for their services. Traditionally, the seller negotiated and paid this commission as part of the overall transaction process.

Historically, in the United States, listing agents negotiated the BAC with sellers upfront. However, this structure has now changed significantly due to the MLS rule updates, which were largely driven by legal pressures and calls for transparency.

What Changed in the MLS Rules?

On August 17, 2024, the real estate industry adopted new rules aimed at creating greater clarity and fairness in transactions. The most notable changes include:

1. Uncoupling Commissions

Sellers are no longer required to offer a set buyer agent commission as part of their MLS listing. This change empowers sellers to decide if and how they want to contribute to the buyer agent’s compensation.

2. Transparency in Commission Agreements

Buyer agents are now required to clearly disclose their commission arrangements to their clients. Buyers must be informed of how their agent is compensated, ensuring they understand their financial obligations.

3. Negotiability of BAC

While commissions were always technically negotiable, this rule change makes it clear that BAC is no longer automatically included in the seller’s costs. Both parties now have greater flexibility to negotiate these terms.

4. Enhanced Buyer Awareness

The new rules encourage buyers to take a more active role in understanding the costs associated with purchasing a home. They may need to negotiate directly with their agent about how the BAC will be handled.

How These Rules Affect Sellers in El Paso (updated 01/29/2025)

For sellers in El Paso, this rule change could mean significant savings. In the past, sellers were often expected to cover buyer agent commissions as part of the transaction. Now, sellers can list their homes without feeling obligated to pay for the buyer’s agent services.

Since the new MLS rules took effect on August 17, 2024, we initially advised my seller clients to let buyers negotiate and cover their own agent’s commission. However, after completing numerous transactions on both sides, We’ve found that offering a total commission of 5.5%—with 3% for us (the listing agent) and 2.5% for the buyer’s agent—usually makes for smoother negotiations. Most buyers either can’t or won’t finance their agent’s fee, so presenting a fair structure from the start typically saves my clients a half-percent overall. Of course, we only provide recommendations; ultimately, it’s your decision as the seller on how to handle buyer agent compensation.
